Legislative business continues to be mostly stalled due to the ongoing Republican walkout in the Oregon Senate. Negotiation attempts between the Democrats and Republicans have been unsuccessful and at the point it feels likely it will continue through the end of session.

Oregon State Board of Nursing (OSBN) updates:

As of June 1, 2023, OSBN has changed its listserve. If you want to receive email (or continue receiving emails) from OSBN you must sign up here.

On May 30, 2023, the Oregon State Board of Nursing (OSBN) held a public listening session to hear public input about possibly consolidating CNA 1 and 2 certifications. A vast majority of individuals who spoke were opposed to merging the certifications. We will keep you posted on what happens from here.

Nursing Homes: CMS Ends Staff Vax Mandate and Finalizes Certain Other Provisions 

On May 31, CMS posted a final rule in the Federal Register that ends the COVID-19 vaccination mandate for staff in CMS-certified settings. The rule is currently scheduled for June 5. CMS will NOT be enforcing staff vaccination requirements between the end of the public health emergency and the effective date of this rule. The rule finalizes provisions of the May 2021 interim final rule requiring nursing homes to educate residents and staff on COVID-19 vaccination and offer or assist with accessing COVID-19 vaccination for any residents and staff who accept. The rule also removes expired language from the May 2020 testing rule that expired with the end of the public health emergency. Testing for COVID is still required in accordance with “accepted national standards” under 42 CFR Section 483.80 Infection Control. LeadingAge national will release a more comprehensive review of this final rule in the coming days.

Debt Deal Rescinds $39M HUD Multifamily Funds, Caps FY24 Spending

Tens of millions will be rescinded from Department of Housing and Urban Development (HUD) multifamily programs from unobligated COVID relief funds and overall federal non-defense discretionary spending, including for HUD programs, for fiscal year 2024 will be at no more than fiscal year 2023 levels in a debt ceiling deal passed by the House and Senate May 31 and June 1.
